Unified Legal Terms and Disclosures

Welcome to Builtzer, a digital platform and mobile application that connects new home builders, home buyers, and service providers. By using our platform—whether through the website, mobile app, or partner network—you agree to the following legally binding terms and policies. These terms are designed to protect Builtzer, its users, and its partners while ensuring transparency, privacy, and accountability.
1. Platform Scope and User Eligibility
The Builtzer platform is intended for users who are at least 18 years of age and legally capable of entering into binding agreements. Access to the platform is granted upon registration by the user or through invitation by a registered builder. Use of the platform constitutes acceptance of all stated terms, policies, and updates as they may occur from time to time.
2. Registration and Builder Policy
Users may register independently to explore builder profiles or may be registered directly by a builder. Upon registration with a builder, the user’s information—including name, contact details, selected preferences, and household members—is shared with that builder to enable communication, document sharing, project management, and engagement via tools such as HomeHub and the Customer Toolbox. Each builder may establish its own registration criteria, which may include eligibility rules, verification requirements, and internal policies. If applicable, these builder-specific registration policies will be linked within the registration confirmation email or shown during the registration process. Users may register with more than one builder, and each builder relationship is managed independently through the platform.
3. Realtor Registration and Buyer Agency Relationships
Buyers may have a real estate agent (realtor) affiliated with their account. Realtors may be added by the buyer or by the builder. The terms of the buyer-agent relationship, including the nature of representation, commission agreements, or agency disclosure obligations, are to be established and agreed upon directly among the buyer, the builder, and the agent. Builtzer does not control, verify, or mediate these relationships. Realtor access to a buyer’s account and associated records is managed by the parties involved and may be revoked at any time by the buyer or builder.
4. Content Responsibility and Platform Role
Builders are solely responsible for the accuracy, quality, and timeliness of the information presented in their profiles, listings, HomeHub pages, or Customer Toolbox uploads. This includes home designs, community offerings, pricing, “Available Now” homes, documents, and any communications initiated through the platform. Builtzer serves solely as a technology provider and does not author, verify, edit, or endorse content shared by builders or other third parties. As such, Builtzer disclaims all liability related to builder-generated content or errors in home pricing, availability, and features.
5. Certified Partner Visibility and Engagement
Builtzer hosts a Certified Partner Network that includes lenders, title companies, and home-related service providers. These partners are displayed based on declared service areas and the user’s builder affiliations or geographic preferences. Partners do not pay for referrals and are visible to all users on an equal basis. Communication with Certified Partners occurs only at the discretion of the user. Builtzer does not provide user data to partners unless the user explicitly initiates a conversation. All Certified Partners must provide accurate information and comply with local licensing, advertising, and consumer protection regulations.
6. Data Collection and Use
Builtzer collects user information to support account creation, platform functionality, personalized home search, builder engagement, and analytics. Data collected may include names, contact details, device information, platform activity, and files shared between users and builders. Information shared with builders, household members, or partners is limited to what is necessary to support the requested service. Personal data is never sold. All data handling practices comply with applicable data protection laws.
7. Data Storage, Security, and Protection
Builtzer is committed to securing all user data. Information is stored in encrypted environments hosted on secure cloud-based servers. We use industry-standard protections including SSL encryption, access controls, and monitoring to detect and prevent unauthorized access. However, while we take all reasonable precautions, no system can be guaranteed to be 100% secure. Users are encouraged to use strong passwords, enable device security, and report any suspicious activity. Access to sensitive account data is limited to users, verified builders, and system administrators on a need-to-know basis. Builders are expected to comply with reasonable data handling practices when accessing buyer information shared through the platform.
8. HomeHub and Builder-Controlled Tools
HomeHub is a builder-managed feature of the Builtzer platform. Once a user registers with a builder, the builder may activate HomeHub to share project milestones, upload documents, assign tasks, or communicate updates. The contents, frequency, and visibility of HomeHub entries are entirely controlled by the builder. Builtzer does not review or filter HomeHub content and is not responsible for missed deadlines, delays, or discrepancies resulting from builder activity.
9. The Builtzer Customer Mobile App and Responsibility for Shared Information
The Builtzer Customer Mobile App serves as a centralized communication and experience tool for home buyers and household members. Any information shown within the app—such as builder profiles, home listings, pricing, status updates, or shared documents—is created and controlled by the builder and their representatives. Builtzer does not create, review, or verify the content included in any builder profile or message. All documents, files, or progress updates shared within the app are the responsibility of the builder.
Home Builder Representatives are responsible for managing the customer experience, maintaining accurate data, and delivering timely communication. Buyers understand and accept that any decisions made based on information within the mobile app should be verified directly with the builder. Builtzer functions solely as a technology provider that enables these parties to interact. As such, Builtzer disclaims all liability for delays, omissions, inaccuracies, or errors in any data presented within the mobile app, including errors in price, availability, or construction status.
10. Acceptable Use and User Conduct
Users agree to use the Builtzer platform solely for lawful, personal, and home-buying-related purposes. Unauthorized use, including impersonation, misrepresentation, scraping, or resale of the platform, is strictly prohibited. Any abuse of the system, transmission of harmful content, or interference with the functionality of the platform may result in immediate account suspension or termination.
11. Disclaimers and Limitation of Liability
Builtzer provides the platform “as is” and makes no express or implied warranties about its accuracy, availability, or fitness for any particular purpose. Builtzer does not guarantee continuous service and shall not be liable for any loss, damage, or inconvenience resulting from service interruptions, inaccuracies in builder or partner content, or user errors. Liability is limited to the fullest extent permitted by law.
12. Intellectual Property
All content, branding, features, and code on the Builtzer platform are owned by Builtzer or its licensors. Users and partners may not copy, reverse engineer, modify, or commercially exploit the platform or any of its elements without express written permission.
13. Termination
Builtzer may suspend or terminate a user, builder, or partner account at its sole discretion if terms are violated or misuse is detected. Users may request account deletion at any time by contacting Builtzer support. Builders and partners may request deactivation of their profiles according to separate contractual terms if applicable.
14. Governing Law and Dispute Resolution
These terms are governed by the laws of the state of [Insert State], without regard to conflict of law principles. Any disputes arising under these terms will be resolved through binding arbitration or in the courts of Nebraska, unless otherwise required by law.
15. Use of Third-Party Services
To deliver key platform features and ensure scalability, Builtzer relies on trusted third-party services such as Google Cloud (for infrastructure and hosting), SendGrid (for transactional email delivery), and One Signal (for push notifications). These providers operate independently of Builtzer and are responsible for the availability of their own systems. While we choose reputable vendors and monitor service availability, we are not liable for any disruptions, data delays, or outages caused by these providers. You acknowledge that portions of the Builtzer platform may be temporarily unavailable due to issues outside our direct control.
16. Modifications to Terms
Builtzer reserves the right to update or modify these terms and policies at any time. When material changes are made, users will be notified via email or in-app notification. Continued use of the platform constitutes acceptance of the revised terms.
