Builtzer Mobile App – User Agreement

Effective Date: Auguest 1, 2025

Welcome to the Builtzer mobile application ("App"), designed to help you connect with new home builders, explore listings, manage your experience, and access trusted partners. By creating an account or using the App, you agree to this User Agreement. If you do not agree, please discontinue use.

Who is a Builtzer Mobile App User?

Builtzer mobile users are typically individuals participating in the new home buying process. You may be:

  • Self-registered Buyer: You downloaded the App and created your own account to search for home builders, explore new homes, and view certified partner options.
  • Builder-registered Buyer: Your builder created your account to support communication, documentation, and the buying experience.
  • Household Member: You were invited by the primary buyer to view shared documents, updates, and participate in builder-related communication.

Mobile users do not have administrative access to builder tools. What you see depends on builder sharing, partner visibility, and your app activity.

1. Account Creation & Builder Registration

Your Builtzer account may be created in one of two ways:

  • Self-registration: You independently create an account to explore builder listings, profiles, and partner services.
  • Builder-initiated registration: A home builder invites or registers you directly to begin managing your buyer experience.

When you register with a home builder through the app, your information (name, contact details, preferences, and household members) will be shared with that builder to help them manage your home buying journey. This connection enables them to provide documents, pricing, and communication via tools like HomeHub and the Customer Toolbox.

You may register with one or more builders at any time. Registration policies—including eligibility, timing, and requirements—are determined by each builder. If applicable, the builder’s registration policy is linked in your registration confirmation email.

2. Home Search, Builder Discovery & Local Tools

Builtzer offers personalized tools to help you navigate the new home buying process:

  • Local Builder Directory: Browse builders in your area, view profiles, and request registration.
  • Home Search: Discover new homes and communities based on your location and preferences.
  • Recommended Designs & Communities: Receive curated suggestions based on search behavior, region, and available builder data.
  • Certified Partner Visibility: Lenders, title companies, and service providers appear based on their declared service areas and your location or builder activity.

3. Builder-Controlled Access & Locked Information

Certain tools and content are only available once you have registered with a builder. These include:

  • "Available Now" Homes: Listings of move-in-ready homes released by a builder.
  • Customer Toolbox: A secure space where builders may share documents, updates, and files related to your home purchase.
  • Base Price Sheet Tool: Pricing and design data provided by the builder for their homes and communities.

Builder-shared content is only accessible while your registration is active. Builtzer does not control or verify this content.

4. HomeHub & Builder-Controlled Tools

HomeHub is your personalized buyer experience hub, visible after builder registration. It may include:

  • Project progress and status updates
  • Builder messages and reminders
  • Document uploads and selections
  • Key contacts and service resources

All HomeHub content is managed by the builder team—not by Builtzer. Each builder may offer a unique experience depending on their internal process and tools.

5. Certified Partner Network

Builtzer displays a network of third-party providers to support your home journey. These include lenders, title companies, and home-related service partners. Please note:

  • Certified Partners are not affiliated with any specific builder.
  • They are shown based on declared service areas and may appear based on your location or builder registration.
  • All communication with Certified Partners must be initiated by you (inbound only).
  • Certified Partners do not pay referral fees and cannot contact you unless you reach out.

6. Realtor Registration

If you are working with a real estate agent, they may be added to your experience by you or the builder. Realtor access and visibility are coordinated by the builder, realtor, and buyer collectively. Each party manages their level of involvement, and registration policies vary per builder.

7. Household Access

You may invite household members to your account. These users will gain access to any content, updates, or communications shared by your builder. You are responsible for managing and removing access as needed.

8. Builder Profile Content & Disclaimers

Each builder controls the content shown in their profile, including:

  • Company information, community highlights, and offerings
  • Available home listings and base pricing
  • Promotional materials and downloadable documents

All content is provided by the builder. Builtzer does not edit, validate, or guarantee builder-supplied data. Questions about homes, pricing, or timelines should be directed to the builder directly.

9. User Responsibilities

By using the App, you agree to:

  • Provide accurate and complete information
  • Use the App only for personal, lawful purposes
  • Respect the privacy, content, and tools provided by builders and partners

10. Privacy

Your use of the App is subject to our Privacy Policy, which describes how your information is collected, stored, and shared. When you register with a builder, your details will be made visible to that builder for management of your buyer experience.

11. Acceptable Use

You agree not to:

  • Access or interfere with accounts you don’t own
  • Use the App to upload malicious content or violate any law
  • Repurpose App content for commercial use
  • Falsely represent your identity or builder affiliation

12. Third-Party Tools and Builder Content

Some services or tools are powered by builders or third-party providers. Builtzer is not responsible for inaccuracies or omissions in builder-supplied content or external services.

13. Account Termination

We may suspend or terminate your access if you misuse the App or violate these terms. Your builder may also revoke your access. You may request account deletion by contacting support.

14. Disclaimers

The App is provided “as is.” Builtzer does not guarantee builder responsiveness, accuracy of listings, or the performance of certified partners. Use the App and its content at your discretion.

15. Limitation of Liability

Builtzer is not liable for indirect, incidental, or consequential damages related to your use of the App or reliance on builder-supplied or partner content.

16. Modifications to this Agreement

We may update this Agreement periodically. Significant changes will be shared in-app or via email. Continued use of the App after updates constitutes acceptance.

17. Governing Law

This Agreement is governed by the laws of the state of Nebraska, without regard to conflict of law principles.

Builtzer Mobile App – Privacy Policy

Builtzer ("we," "our," or "us") is committed to protecting the privacy of mobile app users ("you"). This Privacy Policy explains how we collect, use, share, and safeguard your personal information when you use the Builtzer mobile application ("App").

Who is a Builtzer Mobile App User?

Mobile users are typically individuals involved in the new home buying process, including:

  • Self-registered Buyers: Users who download the app and create an account to search for builders and homes.
  • Builder-registered Buyers: Users whose accounts were created or invited by a home builder.
  • Household Members: Individuals invited by a primary buyer to participate in the buying journey.

1. Information We Collect

We collect the following types of information:

  • Personal Information: Name, email, phone number, address (if provided), and any household members you invite.
  • Registration Details: Whether your account was created by you or a builder, and which builder(s) you're connected to.
  • Usage Data: App interactions, search activity, preferences, viewed builders or listings, and page views.
  • Device Data: Device type, OS version, app version, and general location data (if enabled).
  • Documents & Media: Any files, forms, or images shared by you, your builder, or within your HomeHub.

2. How We Use Your Information

We use your information to:

  • Create and manage your Builtzer account
  • Enable builder registration and connection to your chosen builder(s)
  • Deliver personalized home search results, designs, and builder recommendations
  • Display relevant Certified Partners based on location and builder activity
  • Provide access to builder-controlled tools like HomeHub and the Customer Toolbox
  • Analyze app usage and improve the user experience

3. How Information Is Shared

We do not sell your data. Your information is shared only under the following conditions:

  • With Builders: When you register with a builder (via self-request or builder invitation), your information is shared with them so they can manage your experience. This may include your name, contact info, search activity, household members, and any shared files or messages.
  • With Certified Partners: You control when and if a partner sees your information. Partners only gain access after you initiate contact. Builtzer does not share your data with partners by default.
  • With Household Members: If you add household members, they will be able to view any shared content and communication from your builder.
  • With Service Providers: We use secure third-party services (e.g., hosting, analytics) that help us operate the platform under strict confidentiality agreements.

4. Builder Registration Process

When you register with a builder via the app, you authorize Builtzer to share your profile and relevant data with that builder so they can support your home buying experience. Builders may view and update details in your record and provide documents, updates, and communication tools accordingly.

You may register with multiple builders within the app. Each builder may have their own registration policy, and if applicable, their terms or requirements will be linked in your registration confirmation email.

5. HomeHub (Builder-Managed)

HomeHub is a personalized section of the app that activates once you’re registered with a builder. It may include:

  • Construction progress updates
  • Document uploads (contracts, selections, warranties)
  • Builder contacts and messaging
  • Key events and reminders

All HomeHub content is managed and updated by your builder. Builtzer does not control the content, timing, or availability of HomeHub updates.

6. Realtor Registration

If you’re working with a real estate agent, they may be added to your account by you or your builder. Realtor relationships are managed and determined collectively by you, your builder, and the agent. Visibility, access, and involvement are builder-controlled.

7. Your Rights & Choices

You may:

  • Access or update your account information
  • Add or remove household members
  • Request a list of builders or partners you’ve interacted with
  • Request to delete your account by emailing support@builtzer.com
  • Decline to interact with Certified Partners at any time

8. Data Retention

We retain your data while your account is active. Builder-related documents or history may be retained based on the builder’s own policy. You may request deletion, but your builder may retain project documents as part of their own compliance or transaction records.

9. Security

We use industry-standard encryption and security measures to protect your data. However, no app or platform is 100% secure. We encourage strong password use and device protection.

10. Children’s Privacy

This App is intended for users age 18 and older. We do not knowingly collect data from minors. If we become aware that a child has registered, we will delete the account and associated data.

11. Changes to This Policy

We may revise this Privacy Policy from time to time. Significant changes will be communicated through the App or by email. Continued use means you accept the updated policy.
